Agreement to Terms
Welcome to Vivv! These Terms of Use ("Terms") constitute a legally binding agreement between you and Vivv ("we," "our," or "us") governing your access to and use of the Vivv platform, website, and services (collectively, the "Service").
By creating an account or using Vivv, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
Eligibility and Account Requirements
Age Requirement
You must be at least 18 years old to use Vivv.
By creating an account, you represent and warrant that you are 18 years of age or older, have the legal capacity to enter into these Terms, and are not prohibited from using the Service under applicable law.
Account Registration
To use Vivv, you must:
- Create an account with accurate and complete information
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Accept full responsibility for all activities under your account
Account Security
You are responsible for:
- Maintaining the confidentiality of your password and account
- All activities that occur under your account
- Notifying us immediately of any unauthorized use or security breach
We are not liable for any loss or damage arising from your failure to protect your account.
Service Description
Vivv is an AI-powered video creation platform that enables users to:
- Generate scripts, characters, and storyboards using artificial intelligence
- Create videos from text descriptions, images, and other assets
- Customize and edit AI-generated content
- Download and share created videos
Service Availability: We strive for high availability but do not guarantee uninterrupted access. The Service may be modified, suspended, or discontinued at any time.
Credit System and Payments
Credits Overview
Vivv operates on a credit-based system:
- Credits are required to generate content (scripts, storyboards, videos)
- Credit costs vary based on the complexity and type of generation
- Free trial credits are provided to new users
- Credits can be purchased through our platform
Account Types and Data Retention
Free Accounts
- Receive initial free trial credits
- Data retention: All account data and content is automatically deleted 1 year from account creation date
- Deletion warnings: You will receive notifications at 11 months and 2 weeks before deletion
- Preservation: Upgrade to a paid plan before the 1-year mark to preserve your data
Paid Accounts
- Purchase credit packages as needed
- Data retention: Your data is retained indefinitely while your account remains active
- Even if you stop purchasing credits, your account remains active and data is preserved
- Data is only deleted if you explicitly request account deletion
Purchasing Credits
- Credits are purchased through secure payment processors (Freemius or other authorized providers)
- All credit purchases are final and non-refundable except as required by law
- Prices are subject to change with prior notice
- You agree to pay all applicable fees and taxes
Refunds
Refunds may be provided at our sole discretion in cases of:
- Technical errors that prevent service delivery
- Duplicate charges or payment processing errors
- Violation of these Terms by us

User Content and Intellectual Property
Your Content
"Your Content" means all content you upload, create, or provide on Vivv, including:
- Images, videos, and assets you upload
- Business descriptions and text you provide
- Scripts, storyboards, and projects you create
- AI-generated content created through your use of the Service
You retain ownership of Your Content.
License to Your Content
By using Vivv, you grant us a worldwide, non-exclusive, royalty-free license to:
- Process and store Your Content to provide the Service
- Use AI/ML systems to generate videos, images, and other content based on Your Content
- Display and transmit Your Content as necessary to operate the Service
- Create derivative works (AI-generated videos, edited versions) as you request
- Backup and archive Your Content for service reliability
This license exists only to operate the Service and ends when you delete Your Content or close your account (subject to data retention periods in our Privacy Policy).
Content Restrictions
You may not upload, create, or share content that:
- Violates any law or regulation
- Infringes on intellectual property rights of others
- Contains viruses, malware, or harmful code
- Depicts illegal activities or violence
- Contains hate speech, harassment, or discrimination
- Includes personal information of others without consent
- Is sexually explicit or pornographic
- Impersonates others or is fraudulent
Public Sharing and Links
⚠️ When you share a video via a public link:
- The link is accessible to anyone who has it
- Anyone with the link can view the video
- You control whether to share links (sharing is optional)
- You can revoke access by deleting the video or disabling the share link
- You are responsible for what you choose to share publicly
Vivv Intellectual Property
Vivv and all related trademarks, logos, designs, and content (excluding Your Content) are owned by us or our licensors. This includes the platform, software, technology, AI models, website design, and all materials we create.
You may not:
- Copy, modify, or distribute our intellectual property
- Reverse engineer, decompile, or disassemble our software
- Remove or alter any proprietary notices
- Use our trademarks without permission
Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or business purposes, subject to these Terms.
AI and Technology Disclaimers
AI-Generated Content
Vivv uses artificial intelligence to generate content. You acknowledge and agree that:
- Accuracy: AI-generated content may contain errors, inaccuracies, or inconsistencies
- Originality: While we strive for originality, AI may inadvertently produce content similar to existing works
- No guarantees: We do not guarantee that AI-generated content will meet your expectations
- Your responsibility: You are responsible for reviewing and approving all AI-generated content before use
Not Professional Advice
AI-generated content is for creative and informational purposes only. It is not legal, financial, or professional advice, nor is it a substitute for human expertise or guaranteed to be factually accurate.
Acceptable Use Policy
You agree to use Vivv only for lawful purposes. You will not:
- Violate any applicable laws or regulations
- Infringe on intellectual property or privacy rights
- Upload harmful, offensive, or illegal content
- Harass, threaten, or abuse others
- Impersonate any person or entity
- Interfere with or disrupt the Service
- Attempt to gain unauthorized access to our systems
- Use automated tools (bots, scrapers) without permission
- Resell or redistribute our Service without authorization
- Use the Service for competitive analysis or to build competing products
Enforcement: Violation of this policy may result in content removal, account suspension or termination, legal action, or reporting to law enforcement.
DMCA and Copyright Infringement
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA).

Disclaimers and Warranties
VIVV IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.
We do not warrant that:
- The Service will meet your requirements
- The Service will be uninterrupted, timely, or error-free
- Results from using the Service will be accurate or reliable
- Any errors will be corrected
- The Service is free from viruses or harmful components
Your use of Vivv is at your own risk.
Limitation of Liability
To the fullest extent permitted by law, Vivv shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or failures
- Errors or inaccuracies in content
- Unauthorized access to your content
- Third-party conduct or content
Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
Indemnification
You agree to indemnify, defend, and hold harmless Vivv, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your Content and any claims it infringes third-party rights
- Your violation of these Terms
- Your violation of any law or third-party rights
- Your negligence or willful misconduct
Termination
Termination by You
You may terminate your account at any time by:
- Using the account deletion feature in your profile settings
- Contacting us at hi@vivv.studio
Upon termination: Your access ends immediately, data is retained per our Privacy Policy (30-day grace period), and purchased credits are forfeited (no refunds).
Termination by Us
We may suspend or terminate your account immediately if you:
- Violate these Terms
- Engage in prohibited activities
- Cause harm to us, other users, or third parties
- Have been inactive according to our data retention policy
Dispute Resolution
Informal Resolution
Before filing a formal claim, you agree to contact us at hi@vivv.studio to attempt to resolve the dispute informally.
Arbitration Agreement
By agreeing to these Terms, you agree to resolve disputes through binding arbitration instead of court, except as noted below.
Class Action Waiver: You agree to bring claims only in your individual capacity, not as part of a class action or representative proceeding.
These Terms of Use are effective as of the "Last Updated" date shown above.
